Wow, guess thats what happens when someone actually says something negative about the military.

The comments that I made were along the lines of me not giving anymore respect to people in the military than I do to a garbage man... for both of them are equally important to our survival.

If we do not have garbage men, we have garbage everywhere, which leads to disease and other sanitation issues which would cause our society to collapse.

I did this to show illustrate why I am so sick of everyone loving the military and listening to an idiots rants because her serves in our country... woopty dooo... doesnt impress me anymore than anyother hard working american. I appreciate what they do, but no more than any other citizen.

So anyway, if you are in the military and think you are better than everyone... go F yourself... and if you want to threaten me, please be an idiot like Gemini and email me... then I have evidence when I bring him to trial for any damage to my computer or identity theft related damage.

And also a little word to the wise Gemini... you make think you have friends in high places in the military.... ha... go to lawschool... then you'll have friends in high places

 Death Penalty
 

This is one of those issues that I personally flip flop on. It all depends on the person who is at trial… makes sense. But the problem is like any rule of law, it is supposed to be consistent in law and just fact sensitive and justice should prevail. However what bothers me is that there are cases where we wrongly convict people. This is disturbing… if the government wrongly kills just one person that is unacceptable.
Some make the argument that the burden on the budget is too strong if we keep filling these prisons and paying for people to serve out life sentences. This is a valid argument, if you’re an economist. As one of my professors has been quoted as saying, “economists are devoid of all human emotion.” That is not an attack on economists it’s a truth. When your job is to weigh out the options and decide what the most wealth enhancing choice is, then that’s what you have to be. However thankfully economists don’t run the world, we still have to consider certain policy and moral issues.
Killing someone is a terrible thing. I would hope everyone can agree with that statement. I also very much understand and agree that if you kill someone then you deserve to die (also if you rape, I mean really rape, or mess around with little kids, or a couple other extreme things). The only problem is that one person. To put someone to death who doesn’t deserve it is the biggest injustice that can occur. We cannot allow a practice like this to go on in our country. We need to find new ways to handle life sentence convicts and all convicts for that matter. I don’t really know enough about the system to comment on what they are… but perhaps something where they are doing some of the back breaking work that us lazy Americans don’t want to do (you know, the ones the illegals take) and let them pay their own way through prison. I remember we used to have prison farms back in the day… maybe we still do in places. I mean more than just the guys in orange shirts on the highway picking up trash. Who knows maybe some good honest work will change some of these people. When you just lock someone away for 10 years, they don’t come out feeling to good about themselves or society. This leads to that dreaded cycle that everyone just shakes away as a bunch of sociological nonsense. It really isn’t nonsense, its one of the few things in life that is true… everything runs in cycles (do the bull dance feel the flow, its circular, harness the good block the bad).
So please remember, if the issue comes up in your state, give it a lot of thought. If you have death penalty you will eventually kill an innocent man. That’s all I got.

 DEBATABLE DEBATES
 

This is just a little observation that i have noticed in today's "debates." As I watch people on tv, or writers on blogstream or people i meet tallk about the issues and debate, i find that it is not really a debate, or a deliberation, or a coming together of thoughts and ideas. It is just two people who think they are right and are going to argue their sides to the death.

To me that is just a waste of time, like arguing religion with a chirstian. That was just a joke, not all christians are unwilling to listen... wait did i just say listen, as in listen to what the other person is saying and perhaps just perhaps agreeing with what that person has just said. It seems like when two parties are arguing they are too proud to concede a point. Out care how strongly you believe in something, you are not right on every point... no one is, there are flaws in every argument, unless you are clarrence darrow or something...although he bribed judges so he wasn't even that good.

And i dont mean to sound like I am writing this from my ivory tower, looking down on all the lonely plebes... sure i do this, but i realize its a problem... and every rehab center will tell you that is the first step... so maybe we can just all sit back and listen to what the other side has to say. So hey sorry to anyone that i have done this to on this forum and lets get some good old fashion debates going... i have primarily been a commentor on this forum, but i think i am going to post everynow and then... and sorry for all the lower cased "i"s. I am your typical bum who is used to autocorrect on microsoft word

And i am very bad at concluding an essay, or a post or what evey you call the gobbli gook that i just wrote, so i am going to ends posts with a quote... most of the time stupid ones

 Sacco and Vanzetti
 

Today i am going to see a documentary based on the case and trial of sacco and vanzetti. They were two itilian immigrants in massachusetts during the early 1920's. There was a bank robbery in broad daylight in which two people were killed. Evidence adduced at trial was inconclusive and inconsistent. One expert said that 2 of the 11 shots look they could have been fired from defendants gun, and another expert said none of them could be fired from defendants gun.

Yet Judge Thayer who would not allow a good deal of the defendants evidence to come through at trial. Why is this? Because he was a well known bigot who was hateful towards immigrants. IN his opinion he reasoned that the verdict did not rest on the expert testimony, but rather on evidence of the defendants "consciousness of guilt"

The case which is still contested to this day was handed over to an independant commission shortly after trial. It was handed over to Lawrence Lowell, the president of Harvard University, another known racist who instituted such policies at the university. So he along with his croney came to the same conclusion much to the dismay of a professor at harvard--Felix Franfurter-- future supreme court justice.

7 years after trial sacco and vanzetti were electricuted and on their death certificate the cause of death says, and i am not kidding.. JUDICIAL HOMICIDE. kind of a fitting name i suppose.

All of this leads me to an alarming problem in our country, trial to a large degree are left up to a judges discretion, and if that judge as in this is a bigot, then injustice is sure to follow. This is something that troubles me more and more as i read judicial opinions. One of my professors has said,

"Frankly, I have had more than enough of judicial opinions that bear no relationship whatsoever to the cases that have been filed and argued before the judges. I am talking about judicial opinions that falsify the facts of the cases that have been argued, judicial opinions that make disingenuous use or omission of material authorities, judicial opinions that cover up these things with no-publication and no-citation rules.”

This kind of non sense happens everyday and the worst part is that it is not a very easily correctable problem. One way i can think of is to hold judges liable if an opinion is found to be biased or prejudicial... however this costs money with review boards and the such, and those boards will be made of corrupt people for sure.

The more i learn about the workings of our government the more i think we need a revolution, not in the violent sense, but a revolution non the less.

 HOMESICK!!!
 

Tomorrow is the start of THE PLAYERS CHAMPIONSHIP, the 5th major on the pga tour. I have lived in ponte vedra, Fl since 98 and have gone to every players championship since then, and have worked on the grounds crew for 5 of them. Now that i am law school in NY, i am missing my first one and it feels aweful.

I am a golf nut and have not been able to play in quite some time. I was swinging my swiffer mop as a golf club while watching the Bay hill invitational last week. The worst part is my girlfriend is still down there on the grounds crew... so while i am sitting here writing this post she is cutting the green on #17, one of the most famous holes in golf...

So i guess i will just watch it on tv... just won't be the same.
